Colorado Workers' Compensation: Civil Lawsuits

Workers’ Compensation Attorneys

If you’ve been injured at work, you are probably dealing with an insurance company that isn’t calling you back, trying to heal from your injuries and stressed out about how you’re going to get back to work. The experienced attorneys and legal staff at McDivitt Law Firm will take over all of these burdens so that all you have to do is focus on getting better.

Do I need an attorney?

Getting an attorney will help you get the benefits and compensation you deserve faster than if you go at it alone. Insurance companies will take you and your case more seriously when they know McDivitt is watching. To find out more about how the Colorado Workers’ Compensation process works, click here.

Once we’re representing you, you never have to speak to the insurance company again. If your check is late, call us. If your doctor is recommending therapy that hasn’t been authorized, or will not prescribe therapy that other doctors have recommended, call us. If you get a bill that should have been paid by Workers’ Compensation, call us. We will do everything legally possible to take care of these issues for you, so you can focus on getting better.

What about my employer?

If you’ve been injured at work, a Workers’ Compensation claim should have been filed by your employer within three working days of your injury. If this hasn’t happened, the attorneys at McDivitt Law Firm can make sure this claim is filed so that you can begin the process of getting the compensation you deserve.

However, as the injured worker, you should not wait any time at all to file your own claim with your employer and seek medical attention. McDivitt Law Firm will file your claim immediately on your behalf and force your employer and insurance company to get you immediate medical attention.

Once your claim is filed, either by your employer or by your attorney, McDivitt Law Firm will completely take over the paperwork, dealing with the insurance company, and ensuring that you’re getting all of the benefits you’re entitled to under the law. Remember, there are benefits you’re entitled to that neither your employer nor insurance company will tell you about.

There are a lot of deadlines and a lot of benefits you may not know about. For example, you can be reimbursed for the mileage for getting to and from doctors appointments related to your work injury. You are entitled to disability pay if you cannot work after your injury, and to a final award of money after you receive Maximum Medical Improvement. Also, the insurance company may not pay you all of the disability pay you’re entitled to, even when it does pay some.

We watch your treatment

If your Workers’ Compensation doctor says you need no more care, but you know you do need more care, your McDivitt attorney will work with you to get a second opinion, and do everything possible to get you the care you need.

You are not suing your employer

Many clients come to us initially and are worried that by hiring an attorney they are suing their employer. This is not the case. In a Workers’ Compensation case, you are not suing anybody. You are only filing a claim for benefits you are entitled to by law. Click here to find out how we can help you.
